Terms and Conditions of Use Version as of June 01, 2011

Any surfer who is connected to this website (the "Site") in order to use it must be over 18 years of age, and is identified in these general conditions by the term "User".
Any use of this Site and the services offered on its pages are subject to these terms and conditions (the "General Conditions").
If you do not agree to comply with the General Conditions, please do not browse the Site or attempt to use the services offered by GPS Network.
These General Conditions are intended to define the relationship between GPS Network and the Users of the services offered on this Site, (the "Services")
The use of some Services may be subject to compliance with specific conditions which will be displayed on this Site from time to time ("Special Conditions"). Any Special Conditions will comprise part of the General Conditions.

1. Connection
To access the Site and use the Services, the User must provide him-or herself with internet access either directly, or through intermediary devices that allow access to internet content, and any telephone connection charges incurred in accessing the network or the Site are solely the responsibility of the User.
The User is also responsible for providing all the necessary equipment, including a computer and modem or other connection tool, to make the connection to the network and, if necessary, a login and email address.

2. Cancellation
GPS Network reserves the right to cancel the account with immediate effect and permanently deny any User access to the Services if:
- The User has given false information at the time of registration;
- The User fundamentally breaches the General Conditions or any Special Conditions, and such breach is either incapable of remedy or, if capable of remedy, is not remedied promptly on GPS Network notification to the User.
GPS Network also has the right to close a User account if it remains inactive for more than ninety (90) consecutive business days.

3. Protection of personal data
GPS Network undertakes to use (including processing) any personal data.
The right to use the Services is personal to each User.
The User shall not sell or use, or attempt or purport to sell or use the Services or any part of the Services for commercial purposes without the prior written consent of GPS Network.
The User is responsible for all uses of his or her account, including by any third party (whether or not authorized by the User).
The User agrees to notify GPS Network immediately in writing, should he or she know of fraudulent use or violation, or attempt at such use or violation, of the security of their account.
If GPS Network is informed of, or has reasonable grounds to believe there has been unauthorized use of a User account number, GPS Network reserves the right to suspend or revoke the User's personal account and deny access immediately and in advance to all or part of the Services to the User.
The User acknowledges, accepts and assumes as an individual full responsibility for the content of transmissions to and via the Site from his or her account.
The User agrees not to use the Site or Services for illegal purposes and, in particular, not to send messages contrary to public order and morality, or defamatory statements, or items that violate the privacy of third parties; not to send messages, information that may harm in any way the rights of GPS Network and / or rights of third parties (in particular not threatening the economic rights of GPS Network and / or third parties), to inform GPS Network of any violation of which the User is aware; not to access or attempt to illegally gain access to other computer systems or networks connected to the Site, not to interfere in the use and enjoyment of the Services by other Users; not to use the Site to transmit viruses, Trojan horses or other harmful programs.

5. Guarantees and Disclaimers
In case of default of delivery or claim, GPS Network provides Users with the option of contacting its Customer Service at the address displayed on the Site.
GPS Network points out, moreover, that the Services are essentially intended for leisure purposes.
Under no circumstances shall the studies displayed on or made available on the Site constitute or be taken as constituting legal, psychological, medical, professional or financial advice, and such studies shall not comprise a substitute for medical or psychological diagnosis made by a health professional.

6. Limitation of liability
To the extent permitted by law, GPS Network will not be liable for incidental damages of any kind, including, without limitation, loss of profits, loss of earnings, loss of image.
GPS Network shall not be responsible if it does not meet its obligations due to events beyond its control or through the fault of third parties.

7. Compensation
The User agrees that neither GPS Network nor any related company nor their affiliates shall be liable to compensate the User for any damage suffered by, or claim or demand against the User (including, without limitation, the costs of lawyers and consultants) arising from third-party acts or omissions in the course of shipment, dissemination or transmission of the content on the Site, or the User’s use of the Services, or the User’s breach of these Terms and Conditions or any relevant rights of third parties.

8. GPS Network’s Rights of ownership
The User acknowledges and agrees that the Site content (which includes with limitation text, software, music, sound, photographs, videos, pictures or other material), any advertising sponsored or distributed by electronic mail, and any commercial information produced by GPS Network, or its suppliers or advertisers, are protected by international property, including trademark and patent law and any other related law or right from time to time in force.
The User is not authorized to copy, use, reproduce, distribute or create derivative works from the Site content without obtaining the express written permission of GPS Network, its suppliers or advertisers.

9. Duration of the General Conditions
The General Conditions and any Special Conditions shall take effect from their acceptance by the User and shall continue for the duration of supply of Services by GPS Network.

10. Modification of the Services and / or of the General Conditions
GPS Network reserves the right to develop or modify all or part of the Services, but will use all reasonable endeavours to ensure that the Services ordered and paid for by the User will be delivered by GPS Network under the terms provided in the Site the day the order is placed.
GPS Network reserves the right to amend the terms of the General Conditions at any time.
In any case, the version of the General Conditions that applies to a User is the one that has been most recently accepted by that User.

11. Notifications and Claims
All formal notifications, complaints and claims must be made in writing and sent by postal mail to the following address: GPS Network Route des Avouillons, 14 CH-1196 Gland.

12. Other
These General Conditions and any Special Conditions constitute the entire agreement between GPS Network and the User with regard to the use of the Services and replace any previous agreement between the User and GPS Network.
If GPS Network does not exercise any of its rights under these General Conditions or any Special Conditions this shall not constitute a waiver thereof.
If any provision of these General Conditions or any Special Conditions is rendered or declared invalid by any law, regulation or judicial decision, the unaffected provisions will remain in force between the parties.

13. Applicable Law
This Agreement and use of the Services are subject to and governed by Swiss laws and regulations.
